Terms of service

These terms govern your use of BuyerPen, a service operated by Henosis Labs (“we”). By creating an account or using the service you agree to them.

What BuyerPen is

BuyerPen is software that helps a real estate licensee prepare a purchase offer: it places the terms you enter on real estate contract forms, collects electronic signatures and initials from the buyers you name, and emails the resulting documents to the recipients you choose. It is not a law firm, brokerage, or licensee and does not give legal advice. You are responsible for the terms of every offer, for reviewing every document before it is sent, and for compliance with your state’s law and your association’s rules.

Forms

The Maine forms available in BuyerPen are the copyrighted work of the Maine Association of REALTORS® and are provided for use by its members and other authorized users. You are responsible for confirming you are permitted to use a form before generating it.

Listing data

Listing details and documents are retrieved from MLS sources you are entitled to access and are kept with the offer as a record of what was sent. Use them only as your MLS rules allow.

Accounts and teams

You are responsible for your credentials and for activity under your account. Team owners and admins may see offers created by team members. Removing a member ends their access; the team keeps its offers.

Signatures and delivery

Signing requests are sent through the e-signature provider connected to your account. Emails to listing agents are sent in your name with replies directed to you. You confirm that the buyers and recipients you enter have agreed to receive these messages.

Payment

Paid plans are billed in advance, monthly or yearly, through Stripe. Per-offer purchases are charged when a PDF is generated. Fees are non-refundable except where required by law. We may change prices with 30 days’ notice.

Acceptable use

Don’t use BuyerPen to misrepresent a buyer, a property, or an offer, to send documents to people who haven’t agreed to receive them, or to interfere with the service or other users.

Availability and liability

The service is provided as is. To the extent permitted by law, Henosis Labs is not liable for indirect or consequential damages, and our total liability is limited to the amount you paid us in the twelve months before the claim.

Termination

You can close your account at any time. We may suspend accounts that violate these terms. On closure you can export your generated PDFs for 30 days.
